In Australia the law is increasingly recognising the impact that family violence has upon not only the immediate victims but also families, friends and workplaces.
In 2018, the Fair Work Commission conducted a review of modern awards. In the course of that review, it was determined that all employees who are experiencing family and/or domestic violence should be able to access five days unpaid leave per year. The review did, however, defer a decision on whether employees should be able to access paid leave.
All employers should keep themselves informed of, both of the obligations that they may owe to employees but also of the implications that changes may have to the operation of their business. Employers refusing to grant an employee their entitlements under a Modern Award will be in breach of the Fair Work Act 2009 (Cth) which can attract penalties.
