What am I entitled to be paid on termination?

March 1, 2018 By Morgan Couzens Legal

Your entitlements on termination depend on:

a. what your contract says (even if it is not written, you still have an employment contract);

b. any Award or enterprise agreement that applies to and covers you in your employment;

c. State laws, such as long service leave laws; and

d. Federal Laws, such as the Fair Work Act 2009 (Cth).

In addition, sometimes a pre-modern Award may specifically change the entitlements described in another source. For example, in some industries long service leave awards or agreements may change your long service leave entitlement.

If you think you have not been paid properly or are not sure, please give us a call on (03) 5722 4681 to discuss whether we can help you.
